The work of the sensitization workshop of parliamentarians on international labor standards(International Labor Organization) continued on Wednesday, November 21, 2018, where participants exchanged long discussions on Convention No. 87 in relation to freedom of association.
This theme was developed by the International Labor Organization(ILO) expert Christina Holmgren.
Referring to Article 2 of the Convention, Ms. Christina Holmgren(pictured above) indicated that “employers and workers without the distinction of any kind, have the right, without prior authorization, to set up organizations of their choice, as well as the right to join these organizations, to the only condition to comply with the statutes of these organizations”.
According to Article 3 of this Convention, workers’ organizations and employers have the right to develop their statutes and by-laws, to elect freely their representatives, to organize their management and activity, and to formulate their program of action.
In this angle, by virtue of this provision, “public authorities must refrain from any intervention likely to limit this right or to hinder its legal exercise”.
In this context, Mrs. Christina Holmgren informed participants that the impediment to freedom of expression and opinion, arbitrary arrests, disappearances, forced exile, seizure of trade union the absence of freedom of movement constitute major handicaps to freedom of association.
Ms. Christina Holmgren pointed out that the creation of a trade union organization requires no prior authorization.
Thus, she said, the registration formalities are acceptable. In case of refusal, the union has the right to use an independent judicial body.
